These terms and conditions of use govern the use of the Hortacasa Portugal website.

1. GENERAL INFORMATION

The information contained on this site is the property of the private limited company Turbilhão de Domivas, Lda with headquarters in Quinta do Pedro, Bairro da Formiga, 7540-236 Santiago do Cacém.

Objectives/Services:  Our website has as main objective to offer its users institutional information and offer of local accommodation services. Access to and use of this website is the sole responsibility of the user, who is subject to acceptance of these terms and conditions of use, the privacy policy and data processing transcribed here. The use of this website as well as the relations between Hortacasa Portugal and users are governed by applicable Portuguese legislation.

Hortacasa Portugal reserves the right to change these terms and conditions of use, or revise the privacy and data processing policy in these identified whenever it sees fit, at any time, with or without prior notice. Click on the “Terms of Use” located on the website to consult its current version. The most current version of the Terms and Conditions of Use supersedes all previous versions.

If you do not agree with these Terms and Conditions of Use, do not use the website. These Terms and Conditions of Use and the Privacy Policy constitute a contract between the customer and Hortacasa Portugal and apply to the use of this website. It is the user's responsibility to read and review them whenever they access the website, in order to be aware of any changes made, as they affect their rights.

RESERVATIONS

When booking any reservation, the Customer must correctly fill in the respective form, indicating, namely, the name, the number of adults and children, the entry and exit dates, always subject to confirmation of availability by Hortacasa Portugal, as well as their personal data and payment information, being fully responsible for the choices made and for the information provided, which must be complete, true and up-to-date.

With the confirmation of the reservation data by the Customer, a reservation code is assigned to him, which must be referenced in all contacts with Hortacasa Portugal.

Booking conditions: 50% signaling of the total amount of the stay in reservations made via email or social networks. The rest is paid until the day of Check-in, by bank transfer. We do not accept payments on site, with the exception of any fee to be charged additionally (animal fee or any other type of meals requested after booking).

In reservations using the reservation form on the website, payment is made in full and through stripe.

Booking cancellation:

Cancellation: If you cancel the reservation in whole or in part up to 15 days before the arrival date, the accommodation will refund the deposit payment.

Late Cancellation: The hotel will charge the deposit amount to the guest. 

Cancellation up to 3 days before arrival, NO SHOW or Early Departure will be charged the amount of the stay.

Minimum stays: 2 nights any time of the year.

Pets: São permitidos animais de estimação mediante aviso prévio. Taxa adicional de 20€ por animal, por estadia (não é por noite). 

Check in: between 3 pm and 7 pm. Outside these hours, prior notice of arrival time is required and is subject to an additional fee.

Check-out: until 11:00 am.

The characteristics of the Accommodation are those stated in the reservation. However, since the photographs were not taken on the day the Client made the reservation, there may be non-substantial differences between the photograph and reality on the date of enjoyment of the services contracted by the Client, which do not entitle the Client to any modification. of the Contract.

The prices shown are per room, however they can be shown per person or depending on other characteristics, which in any case will be duly indicated on the Site when making a reservation.

If the Customer shows up with more people than those indicated in the reservation to use the Accommodation, those responsible for the Local Accommodation may refuse their entry, a situation for which Hortacasa Portugal cannot be held responsible.

As a rule, the Accommodation can be used from 3:00 pm on the day of arrival and must be left free before 11:00 am on the day of departure (in both cases, at the local time of the respective Accommodation). Staying in the Accommodation beyond the departure time may lead to the payment of additional amounts, which are the sole responsibility of the Client.

The Client must comply with the internal regulations for the use of the Hotel, and Hortacasa Portugal cannot be held responsible for damages suffered by the Client as a result of the violation thereof.

2. WEBSITE CONTENT / INTELLECTUAL PROPERTY

“Website content” means all the information on this website, namely text, images, photographs, videos, illustrations, graphic design and web design.

All content is protected by Copyright and Related Rights, and Industrial Property Rights, under Portuguese and European Union laws, international conventions and other laws, and cannot be used outside the conditions accepted on this website and without consent from Hortacasa Portugal.

The contents contained in the website, or any other industrial or intellectual property rights contained therein, are the property of Hortacasa Portugal, its use by unauthorized third parties being expressly prohibited. The content of the website is provided for information and personal use only, and cannot be used, copied, reproduced, distributed, transmitted, disseminated, sold, licensed or, in any other way, exploited for any other purpose without prior written consent. of the respective owner. The user declares not to use, disable or interfere with security-related features of the Website and the Application.

The user may, however, print material contained in this website, provided that it is not altered, whether for personal and non-commercial use, and maintains the indication of the source and copyright, and provided that any other indication of ownership is not removed.

4. USER DUTIES / PROHIBITED USES

The User may download or copy material strictly for personal use, with Hortacasa Portugal retaining the respective copyright.

The User undertakes not to attack or illicitly use Hortacasa Portugal's systems or websites, being responsible for and bearing all costs associated with illicit actions attributed to him.

Among others, the following are considered illegal actions:

a) Test and assess the vulnerability of the system and break the installed security;

b) Install or try to install a virus on the portal;

c) Sending unsolicited emails that include promotions or advertising for products or services;

d) Triggering or attempting to trigger “denial of service” attacks (an attempt to make a system's resources unavailable to its Users).

5. SUSPENSION OR INTERRUPTION OF ACCESS

Hortacasa Portugal reserves the right to interrupt or suspend access to the Hortacasa Portugal websites, for the period it deems necessary, for any technical, administrative, force majeure or other reasons. Without prejudice to the provisions of the previous number, Hortacasa Portugal cannot be held responsible for any suspension or interruption of access that may occur for reasons that are not attributable to it or that are attributable to mere negligence.

9. TRANSMISSION

These Terms and Conditions of Use and any rights and licenses granted herein cannot be transferred or assigned by the user, however, they may be assigned by Hortacasa Portugal to third parties, without any restriction.

11. INTERPRETATION AND JURISDICTION

These Terms and Conditions of Use and the Privacy Policy will be governed by Portuguese law and will be interpreted in accordance with Portuguese law.

Conflicts and disputes of any nature relating to the formation, execution or interpretation of this Agreement will be governed by Portuguese law.
